General Terms and Conditions for the International Media Festival for Prevention 2023 Competition
These General Terms and Conditions apply to participation in the International Media Festival for Prevention competition organised by Berufsgenossenschaft Energie Textil Elektro Medienerzeugnisse (Institution for Statutory Accident Insurance and Prevention in the Precision Engineering and Electrical Industry in Germany), Gustav-Heinemann-Ufer 130, 50968 Köln, Germany/the Electricity and Information sections of the International Social Security Association (hereinafter the “Organisers”).
II. Non-profit event
The IMFP competition is a non-profit event. Participants make the submitted contributions available to the Organisers free of charge. Editing, use, publication and exploitation of the contributions by the Organisers does not give rise to any claim for remuneration for Participants.
The Participants must pay and/or indemnify the Organisers against any fees and charges that may be incurred as a result of publication (such as German GEMA fees and other licence fees).
Participants who provide their contribution on the website undertake to ensure that the submitted web address/URL remains available for evaluation by the jury during the Congress as well as for public Internet access for a period of six months after the award ceremony. Should a contribution be inaccessible, that alone will be sufficient grounds for it to be excluded from the IMFP competition.
Contributions will be made available to all Congress visitors in a media centre. Individual contributions will be broadcasted in a cinema at the XXIII World Congress. Furthermore, at the latest following the end of the Festival, contributions will be made publicly accessible online in a media centre (such as on the IMFP website, www.mediainprevention.org) provided that Participants have given their consent for this purpose.
Provided that the Participants have consented to publication of contributions or to their use for reporting or promotional purposes, then that consent applies in perpetuity. Participants can withdraw such consent from the Organisers in writing with effect for the future at any time without the need to state reasons. The Participants authorise the Organisers to edit contributions for the stated purposes.
IV. Rights of use
Provided that Participants have upon registration for participation in the IMFP consented to publication of the contributions on its website, they grant the Organisers in particular the following rights of use on a non-exclusive basis but without limitation in time, place or substance:
- The right of reproduction, publication and distribution, meaning the right to reproduce the work without limitation, by whatever technical means, notably including digital integration into the website, and to make it publicly available or reproduce it in public;
- The right of publishing on demand, meaning the right to store the work, keep it available for the public, transmit it to one or more requesting parties, in all analogue or digital electronic databases, electronic data networks and telecommunication service networks;
- The right of public reproduction, meaning the right to reproduce the contribution in public commercially or non-commercially by means of audio media, visual media, audiovisual media, multimedia or other data media, notably including magnetic tapes, magnetic tape cassettes, videodiscs, chips, in all formats, using all analogue and digital methods and techniques;
- The right of promotion, meaning the right to use the contribution to promote the website, including in any other media and outside of the Internet, namely on television and in print media, but not for the promotion of third-party products.
The granting of rights includes the use of excerpts of the contributions and use in combination with other contributions. The Organisers notably have the right to abridge the contributions or to use only excerpts or stills from them.
The granting of rights expressly includes all known and unknown forms of provision on the Internet, notably the possibility of integration into paid online services and websites as on the freely accessible Internet.
The Organisers do not have the right, however, the permit users of the website to permanently store (download) the works. The Organisers will not return submitted contributions following the conclusion of the Festival.
By submitting their contributions, Participants declare that they have the right of disposition over the rights of use relating to their contributions. They are responsible for those rights towards the Organisers. Participants must ensure that the rights of use required for production and assessment of contributions, in relation to all copyright and neighbouring rights holders and all others involved in producing the contributions, notwithstanding the rights administered by performing rights societies (notably GEMA), have been properly acquired and that privacy rights or other third-party rights do not prevent the exploitation of the contributions in any form whatsoever. The Participants must indemnify the Organisers against any claims from performing rights societies and/or reimburse the Organisers for any payments they make to performing rights societies on the basis of claims asserted.
V. Limitation of liability/recourse
The Organisers’ liability is limited in scope as follows: The Organisers are liable solely in the event of wilful intent, gross negligence and claims under the Product Liability Act (Produkthaftungsgesetz).
The Organisers’ liability is limited in amount to typical unforeseeable loss or damage. Notwithstanding the above, the Organisers have unlimited liability for loss or damage resulting from injury to life, limb or health. This does not, however, apply in the case of strict liability.
The Organisers reserve the right to modify the Terms and Conditions of Participation and these General Terms and Conditions. The Organisers will provide notification of all significant modifications to this agreement in due time and give Participants the opportunity to review them. Modifications for legal reasons may, however, become immediately effective. Modifications have effect solely for the future. If you do not agree to the modified terms and conditions, you should arrange to have any content you have uploaded deleted.
Should any provision be ineffective, the remaining provisions shall remain unaffected. In all other respects, the statutory provisions apply.
VIII. APPLICABLE LAW
It is agreed that the law of the Federal Republic of Germany applies.
Wherever admissible, the place of jurisdiction shall be Cologne, Germany.
